This End User License Agreement (“Agreement”) is a legal agreement between you and HeroicFX governing your use of the Conga Bonga software, related files, updates, content, and associated services.

By downloading, installing, accessing, or using Conga Bonga, you agree to this Agreement.

HeroicFX is the provider of Conga Bonga.

Subject to this Agreement and your valid purchase, HeroicFX grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Conga Bonga for your own lawful personal or business creative use.

This license is granted to you, not sold to you.

Conga Bonga requires:

• a valid purchase 
• account creation and/or activation 
• password setup 
• an internet connection for login verification 
• compliance with device activation limits and account security requirements 

HeroicFX may apply and enforce reasonable activation limits per account.

You may:

• install and use Conga Bonga on authorized devices linked to your account 
• use Conga Bonga to create original music, compositions, arrangements, projects, and other lawful creative works 
• use exported outputs created with Conga Bonga in your own projects, productions, and commercial or non-commercial works, subject to any third-party content restrictions that may separately apply 

You must not, except where permitted by law:

• copy, redistribute, resell, rent, lease, sublicense, or share Conga Bonga 
• make Conga Bonga available to third parties except through your own authorized use 
• reverse engineer, decompile, disassemble, modify, adapt, translate, or create derivative works of the software 
• attempt to bypass, disable, interfere with, or defeat login verification, licensing, account controls, or device activation systems 
• use the software in a way that is unlawful, fraudulent, abusive, or intended to circumvent the intended licensing model 
• share account credentials in a way that circumvents intended device or account limits 
• remove, alter, or obscure proprietary notices, branding, or copyright information 

Conga Bonga is licensed, not sold.

HeroicFX and its licensors retain all right, title, and interest in and to Conga Bonga, including all software code, interfaces, branding, graphics, text, design elements, and intellectual property rights.

This Agreement does not transfer ownership of Conga Bonga or any related intellectual property to you.

HeroicFX may provide updates, bug fixes, improvements, patches, or feature changes from time to time.

HeroicFX is not required to provide any particular update, feature, or future version unless expressly stated.

Any updates provided by HeroicFX may be governed by this Agreement unless accompanied by separate terms.

Conga Bonga requires internet access for login verification and related account functionality.

Some functions or related services may rely on third-party providers, including payment processing, email delivery, hosting, infrastructure, storage, and download delivery.

HeroicFX is not responsible for outages, failures, or interruptions caused by third-party services, except as required by law.

You are responsible for downloading, storing, installing, and maintaining Conga Bonga on a compatible system.

HeroicFX is not responsible for installation failures, user-side configuration problems, unsupported systems, or issues caused by your hardware, operating system, internet connection, or third-party software, except as required by law.

HeroicFX offers a 7-day risk-free guarantee, in addition to any rights you may have under the Australian Consumer Law.

Nothing in this Agreement excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law. 

HeroicFX may suspend, restrict, or terminate your access to Conga Bonga where reasonably necessary, including where:

• you breach this Agreement 
• you breach related Terms and Conditions or applicable policies 
• HeroicFX reasonably suspects fraud, misuse, unauthorized sharing, circumvention, or account abuse 
• payment is reversed, disputed, refunded, or charged back 
• account security concerns arise 
• continued access would create legal, technical, or security risk 

If this Agreement is terminated:

• your license ends immediately 
• you must stop using Conga Bonga 
• you must delete all copies of the software in your possession or control 
• HeroicFX may disable your account and revoke activations 

To the maximum extent permitted by law, Conga Bonga is provided on an “as is” and “as available” basis.

HeroicFX does not guarantee that Conga Bonga will be uninterrupted, error-free, compatible with every environment, or free from all defects.

Where consumer guarantees or other non-excludable rights apply, this clause operates subject to those rights. Under Australian Consumer Law, businesses must not mislead consumers about consumer guarantees. 

To the maximum extent permitted by law, HeroicFX is not liable for indirect, incidental, special, or consequential loss, including loss of profits, loss of data, loss of business opportunity, or downtime arising from your use of, or inability to use, Conga Bonga.

Where liability cannot be excluded by law, HeroicFX’s liability is limited to the maximum extent permitted by law.

You are solely responsible for how you use Conga Bonga and any content, arrangements, exports, or outputs created using the software.

HeroicFX is not responsible for how you use your outputs, including any publication, distribution, licensing, or legal compliance relating to your own projects.

Conga Bonga may include or rely on third-party components, libraries, or technologies that are subject to their own applicable notices or license terms.

Please refer to HeroicFX’s third-party notices or attributions where applicable.

This Agreement is governed by the laws of New South Wales, Australia, unless otherwise required by applicable law.

HeroicFX may update this Agreement from time to time.

The latest version will be published on heroicfx.com and will take effect from the date shown at the top of the page.
